Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Candlestick websites, applications, devices, and related services (the “Services”) operated by Candlestick (“Candlestick,” “we,” “us,” or “our”).
By signing in or otherwise using the Services as an Account Holder, you agree to these Terms. If you manage a family network on behalf of a household, you represent that you have authority to do so, and “you” includes that household for purposes of these Terms.
1. The Services
Candlestick provides family phone tools—including managed lines, devices, directories, and related software—so households can stay connected. The Services may change over time as we add, modify, or discontinue features. Some features may be in preview or “coming soon” and are provided as-is without commitment as to availability or fitness.
2. Grown-up accounts; children may use phones
Grown-ups are the users. The person who creates and administers a family network (the “Account Holder”) must be at least 18 (or the age of majority where they live), signs in to Candlestick, and is responsible for the account. Children do not create Candlestick accounts and do not sign in.
Children and phones. Children may use Candlestick phones that grown-ups set up on a family network. If you add a child’s information, assign a phone or line for a child, or allow a child to use a Candlestick phone, you represent that you are the child’s parent or legal guardian (or have authority from that parent or guardian), and you consent to Candlestick’s processing of information about that child as described in our Privacy Policy, including COPPA practices and voice recordings. You are responsible for:
- configuring parental controls, contacts, and permissions for each child;
- supervising how children use Candlestick phones; and
- ensuring information you submit about household members is accurate and lawfully provided.
Features such as voicemail may record voices. That content is for the family: it is not shared for third-party advertising or unrelated use, and access is limited to the relevant child or household member and the grown-ups on that network, as described in the Privacy Policy.
You are responsible for keeping Account Holder credentials and connected identity-provider accounts secure, and for promptly notifying us of unauthorized access.
We use third-party authentication providers (including Clerk and, when you choose it, Google) for grown-up sign-in. Your use of those providers is also subject to their terms and policies.
3. Acceptable use
You agree not to:
- use the Services unlawfully or in violation of others’ rights;
- harass, exploit, or endanger children or others;
- attempt to gain unauthorized access to the Services, accounts, devices, or related systems;
- interfere with or disrupt the Services, including via malware, overload, or scraping that impairs performance;
- misrepresent your identity, age, parental status, or affiliation;
- use the Services to send spam or unsolicited commercial communications;
- access or use children’s personal information or voice recordings from the Services for advertising, unrelated profiling, or any purpose not authorized by the Account Holder and our Privacy Policy; or
- reverse engineer the Services except to the extent such restriction is prohibited by law.
We may suspend or terminate access if we reasonably believe you have violated these Terms or present a security, safety, or legal risk— including risks to children.
4. Your content and household data
You retain ownership of content and configuration you submit to the Services (“Your Content”), including directory entries, household settings, and family voicemail or similar recordings stored for your network. You grant Candlestick a limited license to host, store, process, display, and transmit Your Content solely as needed to operate and improve the Services and as otherwise directed by you.
You represent that you have the rights needed to submit Your Content (including authority regarding children’s information) and that it does not infringe others’ rights or violate law, including COPPA and California privacy law where applicable.
5. Our intellectual property
The Services, including software, branding, and documentation, are owned by Candlestick or its licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.
6. Privacy
Our collection and use of personal information—including information about children who use phones, voice recordings, and California consumer rights—is described in our Privacy Policy. We do not use personal information for marketing purposes, and we do not sell personal information.
7. Third-party services
The Services may depend on or link to third-party products (for example, identity providers, carriers, cloud infrastructure, or external sites). We are not responsible for third-party services, and your use of them is governed by their terms. Emergency calling and similar regulated features may have limitations based on device, network, and location; you should not rely on the Services as a substitute for traditional emergency arrangements where required.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANDLESTICK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANDLESTICK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CANDLESTICK FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law. Nothing in these Terms limits rights that cannot be waived under COPPA or other mandatory consumer-protection laws.
10. Indemnity
You will defend and indemnify Candlestick against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Services, your supervision of children’s use of phones, or your violation of these Terms or applicable law—except to the extent caused by Candlestick’s willful misconduct.
11. Changes and termination
We may update these Terms by posting a revised version and updating the “Last updated” date. Continued use after the effective date constitutes acceptance. We may also modify or discontinue the Services. You may stop using the Services at any time and may request deletion of account or child-related information as described in the Privacy Policy. Provisions that by their nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.
12. Governing law
These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless mandatory local law provides otherwise. Courts in San Francisco County, California will have exclusive jurisdiction over disputes, except that either party may seek injunctive relief in any competent court.
